October 31, 2000 For more than two years Vicky Shaffer has been on the run with her daughter, Brianna Winslow. Does the public need to help bring Brianna 'safely home' to her father, whom Vicky believes molested their daughter? I'm not necessarily taking sides. I don't know Vicky Shaffer, and I don't know Mark Winslow. But I saw Vicky's picture on an ADVO advertisement today (October 31) and something just didn't seem quite right. Call it an instinct. Call it a hunch. So I looked up Vicky's name on the Internet to see if anyone had risen to her defense. It's a sure thing that people are going to be assuming Vicky is some sort of monster who has abducted her own child. And why should we assume that? Because ADVO and http://www.missingkids.com/ say she is? I don't buy that. Children are abused in this country every day. That's a sad fact of life. We as a society can only help them to a limited degree. For the most part, these abused kids have to struggle through these experiences on their own, and some of them don't make it. It's great to see organizations like ADVO and MissingKids.Com reaching out to try and help the kids. But why don't they exercise some judgement in these cases? Why do they just blindly try to help put children back into potentially abusive situations? I can't explain exactly why this situation disturbs me so much. Let it suffice to say that though I have never abused any child, I have known children who have been abused. In 1998 Carolyn Cappitelli wrote a letter to the editor of The Daily Star. In that letter Cappitelli wrote: That baby told everyone who would listen what happened. The problem is that the harder Vicky tried to find justice, the more vulnerable she became. She was asking for supervised visits. She never tried to deny visits completely. All she cared about was keeping her baby safe. She would not drop the charges and so the court charged her with harassment and gave total custody to Mark Winslow. Brianna was afraid of him. I witnessed her refusing to change out of her pajamas into clothes on visit day because she didn't want to go with him. She ran around the house locking doors and closing windows and hiding under the bed.I have seen a terrified child behave in just this way. I know what it's like to have to stand by and be unable to comfort the child because the court system says that the father should be taking the child, either for a brief time or temporarily. It's heart-breaking. As a man I feel inherently, completely, that a father has a right to be with his children. But no father has the right to terrorize his children. The courts be damned if a child is afraid. Our founding fathers didn't lay down the law and the system so that it could blindly abuse children in this way. What was in the letter which inspired Carolyn Cappitelli? But what I feel needs to be known is what was NOT said in the paper about Family Court. I was shocked to find out in my own situation, how many childish games are played in serious situations such as this. For example, a professional in a medical-related field can say in court, "Yes, there is only one way these particular grouping of marks can be left on a child's face." Coupled with the child's statement that, "my daddy boomed me the floor," one would assume that all the "proof" necessary exists to begin steps toward protecting a child from such abuses.There's something wrong here, folks. The child is the surest witness of what happened. The court is forbidden to take the child's testimony into consideration. A very young child can certainly misunderstand the concept of sexual molestation. And some nationally reported molestation cases have shown that children can be led into saying things that aren't really true. But giving weight to the doubtfulness of a child's memory or interpretation of events is hardly a sure method of ferreting out the truth. It's a court's first responsibility to do exactly that, is it not? On October 3, 2000 The Daily Star reported that the Otsego County Sherriff was still working on the Shaffer case and the story seems to imply it was the Sherriff's office that contacted the National Center for Missing and Exploited Children and ADVO. The story doesn't say who brought them into the case, but it looks like the police are the guilty parties here. The police are in a very, very tough position when it comes to domestic abuse, even child abuse cases. Their function is to enforce the law, and doubtless Vicky Shaffer is now a criminal because she stood up to the system to protect her child. The Sherriff's Office cannot be held morally responsible for executing its duty. But if Carolyn Cappitelli told the truth, that the child's behavior was videotaped and no one looked at the tape, this is gross negligence on the part of the court system and the police. Why weren't they looking out for the child? And lest the reader think that I am subscribing to hysteria, consider the fact that at least one innocent woman has already been mistakenly identified as Vicky Shaffer. The person who called the Sherriffs Deputies acted solely because she had seen the posters identifying Vicky as an abductress. Did the posters mention the fact that Mark Winslow has been accused of sexually abusing his own child? Of course not. Has Mark Winslow sexually abused his own child? I have no idea. But I'd sure want clear proof he hadn't before I gave him custody of his daughter. The court says, in what limited capacity it's allowed to speak, that it didn't find evidence to support Vicky's allegations. Hence, Vicky was labelled a wrong-doer. Any father who loves his children will put their wellfare first. Is it in Brianna's best interests to see her mother arrested and put in jail? Why? Protecting children should not be a crime. That's one of the most absurd irresponsibilities of our justice system, and sadly more than once justice is abused by the criminals and turned against innocent people. Or, not justice. Let us say simply the law is abused by criminals and turned against innocent people. Who are the criminals in this case? Is Vicky Shaffer morally obligated to put her child at risk simply because the court system and police refused to consider evidence of abuse? And where does this leave the rest of us? If I should see Vicky Shaffer on the street, or someone I believe looks like her, I'm required to report her to the authorities. Otherwise I may myself be breaking the law, in harboring a fugitive or aiding and abetting a fugitive. Is it right that you and I should be put in peril of prosecution if it becomes known we may have knowledge of a fugitive's whereabouts in a questionable matter? Why aren't the National Center for Missing and Exploited Children and ADVO taking measures to ensure they don't bring the wrong parties to justice? If Vicky is found and imprisoned, and Brianna is returned to her father because of these organizations' campaigns, and if he has and resumes abusing his own child, why should those organizations be held guiltless? If they are going to take it upon themselves to track down the criminals abusing our children, shouldn't we hold them accountable for exercising bad judgement? How many children should we sacrifice to irresponsibility and blind compliance to the law? 1, 2, a dozen? What's an acceptable loss? For his part, Mark Winslow has a lot of support, including the child's law guardian. I can tell you from personal experience, guardians in the court system only have the facts they are given to work with. Does that mean Winslow is guilty of the allegations? No. But why didn't someone look at the videotape of the terrified child? Bernier said she was "very skeptical" of Winslow at the start, but no credible evidence that he was molesting the child ever was produced. At the trial's conclusion, the court found Shaffer's motives for making the charges to be questionable and awarded custody to Winslow. Two years later, Bernier said she still believes the court was right.Hm. "The court found Shaffer's motives to be questionable". The problem here is that we, the public (who are expected to track down and see that this vicious mother is arrested and parted from her child), have to take these news stories at face value. The court MUST be right, right? Do courts ever make mistakes? What did the court feel her motives were, and why were they deemed questionable? The news media and child safety organizations haven't really tried to find out, apparently. Shouldn't we be given assurances that the court was right? Otsego County Social Services Commissioner Charles Christman said he cannot acknowledge there was such a case in family court. Generally speaking, he said DSS would take such a case very seriously and the county has excellent family court judges who search diligently for the truth.Unfortunately for all parties involved, the system is preventing the pubic from holding the court responsible for its own actions. How do we determine that the courts are handling all the cases properly? Statistically we know that some cases fall through the cracks. But what is the mechanism for ensuring that such cases are reviewed, if any? And if we don't have any, shouldn't we be thinking about creating some? Peggy O'Connor, director of Crisis Intervention and Support Services at Opportunities for Otsego, said the area and nation are suffering from an "epidemic" of sexual abuse, and that often children's testimony is given short shrift.I can believe this, too. Children are seldom believed when they report they are being abused. Why is that? Anyone who has raised a child, or who remembers being a child, knows children can and do lie. But children lie to avoid getting into trouble. Why would a child lie about sexual abuse? What is so terrifying to a child that he or she would falsely accuse an adult of sexual molestation? Well, that's a complicated issue. Historians generally agree that the Salem Witch trials most likely arose as a result of teenagers going on a binge and subscribing to what could be called a hysterical rollercoaster. That is, they lied. And matters proceeded in such a pace and direction that the teenagers (it is believed) either convinced themselves the lies were true or were afraid to confess that they had lied. And as a result several probably innocent women were put to death, or otherwise punished. Imagine what those girls could have done had they had access to the Internet and organizations like the National Center for Missing and Exploited Children and ADVO. In an article published in The Daily Star in October, 1998, Charles W. Clickman Jr. of Child Watch of North America was quoted as saying, "Our main concern is Brianna. Our main priority is to get Brianna home safely." Excuse me? Where are the guarantees of the child's safety? Where is the evidence that Brianna was placed in any danger by her mother? Why didn't these people acknowledge the fact that there was no evidence Brianna was in any danger from her mother? And if there was such evidence, why are the news stories sadly lacking in their coverage of it? How does villifying Vicky Shaffer by implication serve the best interests of Brianna? Both sides of the family are working with outside organizations. Winslow has been helped by Child Watch and Martin is active with the National Alliance for Family Court Justice.Well, at least both sides have their advocates. Unfortunately, Mark Winslow has the advantage, and it's not in Brianna's best interests for either parent to have the advantage when clearly there is so much conflicting evidence in the situation. Who is right, who is lying, who is telling the truth are all important issues. But Brianna is also important, isn't she? Why was this child's mother driven to the point of committing a felony crime? Something is happening here and the courts have turned a blind eye to it. It may be nothing more than a child reacting irrationally to a father's unexpected behavior. The problem is that now two years have passed. If Brianna could have testified to anything at all in court back in 1998, it's highly doubtful she could reveal anything of value now. She's only five years old, and five-year-old children don't usually remember much about when they were three. Vicky may one day be arrested, tried, and convicted on a felony charge, but will justice ever be found in this case? I don't think so. Brianna, wherever you are, my best wishes go with you. Grow up and have a safe, happy life. And stay away from those child organizations. I don't trust them any more. All citations are taken from the articles mentioned immediately preceding them.
